Can we keep buyer depost and sue appraiser?

We sold our house about a month ago. The buyers were non-contingent. They have signed off on everything except the appraisal. Our house is 3133 square feet and county records show that. The appaiser says it is only 2864 square feet and did not measure the house. He is basing it off of comps in the neighborhood. We have an extra room that those homes don’t have. The house appraised for the purchase price, but the buyers might back out because they think the house is smaller than what was listed because of what the appraiser is saying. Are we entitled to the buyers deposit? Can we sue the appraiser for giving out wrong information which resulted us in the loss of a sale? The market has dropped since we sold and there is no way we can come close to getting another offer like this.
Thanks to everyone who responded. It turns on the appraiser was WRONG. He came back, not very willingly, and admitted that he missed an entire room and not the room we thought. We are still trying to figure out how you can walk past this particular room and assume that it is not part of the house. The thing that irritates me the most is he claimed, I don’t get paid to come back a second time. Well, if you do your job right the first time, you wouldn’t have to come back. I know mistakes happen, but he was so adamant that he wasn’t wrong, even when we were providing all the facts that he was. Sorry for the vent! This is a very stressful time.

What is the best way to go about putting an offer in on a home?

The county appraisal and the sale price are significantly different. I don’t have a basis of comparison b/c other homes in that neighborhood have not been up for sale lately. I want to present an offer, but I don’t know what I should do?
P.s. I didn’t want to get a real estate agent involved….I’ve already found the house I want.

Appraisal Value after improvements?

I just bought a home here in Arizona for $110,000.00. My husband and I replaced the carpeting in the house with high quality porcelain tile, the entire support under the house was once wood, which many know is a termite risk, and had it replaced with concrete, the lower half of the siding on the house was fiberglass, it is now concrete board siding, we have repainted the entire interior of the home to a soft white, when it was pink and yellow. And all the appliances are brand new and totally updated. We have only lived here 6 months and about 2 years ago, the house appraised at $88,000.00. I am trying to get an equity loan, and this home needs to appraise at $102,000 or more. Do you think it will?

I think an appraiser undervalued our land. How can I find out what land is selling for in my area?

I live in Osceola County, in an area known as Poinciana. I know that there are lots for sale in my neighborhood that are listed as high as $75000. My lot was valued at $25000 in a recent appraisal, and I would like to find out if that is accurate.

appraisal done on home we want to buy; appraiser states needs painting before sale; can we negotiate w/buyer?

We have a signed offer with seller and have done all the paperwork for mortgage loan. appraisal was just done and they say it is a loan requirement to paint the house first or loan can’t proceed. Have gone to real estate agent to negotiate with seller for cost of this fix-up.
