My husband and I recently signed a new construction contract along with another contract to purchase vacant land in a housing development that the house is to be built on. We are in the process of applying for the new construction mortgage and we have not yet been approved. Since signing the contracts, we recently saw the first completed home in the development. We are not happy with the quality of the work by our builder and we don’t want to proceed with him. We would like to build the house with another builder in another development. The land is still vacant and construction of the house is to begin after we obtain our mortgage. In the contract for purchasing the vacant land, it’s stated that the sale is contingent upon the buyer obtaining financing. As I stated above, we have only applied for the mortagage and have not closed on it. I’d appreciate any input on this matter.
She signed a cash of sale agreement that waived her rights. It states the HE is acquiring the property as HIS SEPARATE PROPERTY with his separate funds, for use under his separate admin. and control – BUT the house payments were paid with community funds – with both of their paychecks. Does she have legal rights to it in the property settlement of a divorce?

Selling our home to a private party that just wants to write up a simple agreement and we both sign it.
Has anyone had any experences with this.
The house I was considering for purchase was advertised as 5 years old, but really was 10 years old and was left sitting unfinished for 5 years. This was never disclosed to me by either the realtor or the owner. The only way I found out about it was when I insisted on the owner filling out the disclosure form which he was very reluctant to do. The agreement of sale was presented to me first and my wife and I stupidly signed it without seeing the disclosure form. Had we known the house was sitting out in the elements for 5 years we would have never entered into this. Also the owner has admitted there is a landfill behind the house(it is covered), and the town is remediating the problem, a lie. this is probably a job for the EPA as we were told there is benzene on this land. They have our deposit money 5000 Dollars and dont seem to be in any hurry to refund it, even after my lawyer sent them a threating letter. Is there anybody who could help, without going to court? thanks a lot.
